If you do not agree with its terms, please discontinue use of our Services.

We may update this Privacy Policy from time to time. We will notify you of any changes by updating the “Last Updated” date above. Your continued use of the Services after any changes constitutes your acceptance of the revised policy.

3. SMS and Text Messaging

3.1 Consent and Opt-In

LeadPointe Notifications is a text message program for registered users of the LeadPointe platform (business owners and their staff). You can opt in two ways: by checking the optional SMS consent box when you register at leadpointe.com/free-trial, or by turning on SMS notifications in your account settings. The consent box is unchecked by default, and you can register and use the Services without checking it. By opting in, you consent to receive text messages from LeadPointe for platform-related alerts such as new leads, task assignments, job updates, and appointment reminders. Consent to receive SMS messages is never a condition of purchasing or using our Services.

3.2 Message Frequency

Message frequency varies based on your account activity and notification preferences.

3.3 Message and Data Rates

Message and data rates may apply. You are responsible for any fees charged by your mobile carrier.

3.4 Opt-Out

You may opt out of SMS notifications at any time by replying STOP to any message or by disabling SMS notifications in your account settings at crm.leadpointe.com/crm/notification-preferences. After opting out, you will receive one confirmation message and no further SMS messages will be sent.

3.5 Help

Reply HELP to any message for assistance, or contact us at info@leadpointe.com or 303.489.7484.

3.6 No Sharing of Mobile Information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

4. How We Share Your Information

We do not sell, trade, or rent your personal information to third parties. We may share your information only in the following limited circumstances:

  • Service Providers: We share information with trusted third-party vendors who assist us in operating our Services, including email delivery (Postmark), SMS delivery (Twilio), payment processing, and cloud hosting (Amazon Web Services). These providers are contractually obligated to use your information only to perform services on our behalf.
  • Legal Requirements: We may disclose your information if required to do so by law or in response to a valid legal request such as a subpoena or court order.
  • Business Transfers: In the event of a merger, acquisition, or sale of all or substantially all of our assets, your information may be transferred as part of that transaction. We will notify you of any such change via email or prominent notice on our website.
  • Protection of Rights: We may disclose information where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, or violations of our Terms of Service.

Text messaging originator opt-in data and consent are excluded from all of the categories above and will not be shared with any third parties.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with our Services. If you close your account, we will delete or anonymize your personal information within 90 days, except where we are required to retain it for legal, tax, or regulatory purposes.

6. Cookies

We use cookies and similar tracking technologies to maintain your session, remember your preferences, and analyze usage patterns. You can control cookies through your browser settings; however, disabling cookies may affect the functionality of our Services.

Emails sent through our Services, including account notifications and billing messages, contain a small invisible image that tells us when an email is opened. We use this to confirm that important messages were received. Most email programs let you turn off automatic image loading, which also turns off this signal.

7. Data Security

We implement industry-standard security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include encrypted data transmission (SSL/TLS), access controls, and secure cloud infrastructure. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

8. Your Rights and Choices

You have the following rights regarding your personal information:

  • Access and Correction: You may access and update your personal information at any time through your account settings.
  • Deletion: You may request deletion of your personal information by contacting us. We will fulfill your request subject to any legal obligations to retain certain data.
  • SMS Opt-Out: You may opt out of SMS messages at any time by replying STOP or updating your notification preferences.
  • Email Opt-Out: You may opt out of non-transactional emails by following the unsubscribe link in any email or updating your notification preferences.
  • Data Portability: You may request a copy of the personal data we hold about you in a portable format.

9. Children’s Privacy

Our Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you believe we have inadvertently collected information from a minor, please contact us immediately.

10. Third-Party Links

Our Services may contain links to third-party websites. We are not responsible for the privacy practices of those websites and encourage you to review their privacy policies before providing any personal information.
